Welcome to Sierra. These Terms of Service ("Terms") govern your use of our comprehensive social media management platform that supports Facebook, Instagram, TikTok, YouTube, LinkedIn, Pinterest, X (Twitter), Bluesky, and Mastodon. By accessing or using Sierra, you agree to be bound by these Terms. If you do not agree, please do not use our service.
1. Service Description
Sierra is a comprehensive social media management platform that allows you to:
- Connect accounts from multiple platforms: Facebook Pages, Instagram Business/Creator, TikTok, YouTube, LinkedIn, Pinterest, X (Twitter), Bluesky, and Mastodon
- Schedule and publish posts across all your connected social media accounts
- View analytics and engagement metrics for your content
- Manage multiple social media accounts from a single dashboard
- Create and collaborate in team workspaces with role-based permissions
- Use AI-powered content generation to create captions, hashtags, and post ideas
- Manage media library with images and videos for use across posts
- Save and organize hashtag collections and draft posts
2. Account Requirements
Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use our service.
Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account.
Accurate Information
You agree to provide accurate and complete information when creating your account and to keep this information up to date.
3. Social Media Account Permissions
Authorization
You must have proper authorization to connect and manage the social media accounts you link to Sierra. This includes Facebook Pages, Instagram Business accounts, TikTok accounts, YouTube channels, LinkedIn profiles/pages, Pinterest accounts, X (Twitter) accounts, Bluesky handles, and Mastodon accounts. You represent that you are the owner or an authorized administrator of these accounts.
Permission Grants
By connecting your accounts, you grant us permission to access and use the data necessary to provide our services, including reading account information, publishing posts, uploading media, and fetching analytics on your behalf.
Revocation
You may revoke our access at any time by disconnecting your accounts through our dashboard or through each platform's app settings. Upon revocation, we will delete all associated data including scheduled posts, drafts, and uploaded media for that account.
4. Content Responsibility
You are solely responsible for all content you create, schedule, or publish through Sierra, including content generated with our AI tools. We do not pre-screen, monitor, or endorse user content. AI-generated suggestions should be reviewed before publishing.
You agree NOT to post content that:
- Violates any applicable law or regulation
- Infringes on intellectual property rights of others
- Contains hate speech, harassment, threats, or promotes violence
- Is deceptive, fraudulent, or misleading
- Contains malware, spam, or phishing attempts
- Violates the Community Standards or Platform Policies of any connected platform (Meta, TikTok, YouTube, LinkedIn, Pinterest, X, Bluesky, or Mastodon)
5. Platform Compliance
Platform Terms
You agree to comply with the terms and policies of each platform you connect, including but not limited to: Meta Platform Terms, TikTok Terms, YouTube Terms, LinkedIn User Agreement, Pinterest Terms, and X Terms of Service.
Community Standards
All content published through Sierra must comply with the community standards and guidelines of each respective platform. You are responsible for understanding and following the content policies of platforms where you publish.
No Automation Abuse
You agree not to use Sierra to circumvent rate limits, spam, or engage in any automated behavior that violates any platform's policies. This includes bulk posting, fake engagement, or coordinated inauthentic behavior.
AI Content Disclosure
When using AI-generated content, you are responsible for reviewing and editing the content before publishing. Some platforms may require disclosure of AI-generated content. You agree to comply with any such requirements.
6. Prohibited Activities
You agree NOT to:
- Attempt to reverse engineer, decompile, or disassemble our service
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the service to send spam or unsolicited messages
- Interfere with or disrupt the service or servers
- Resell, sublicense, or commercially exploit the service without authorization
- Scrape or collect data from our service using automated means
7. Service Availability
We strive to provide reliable service, but we do not guarantee uninterrupted availability. Our service depends on third-party platforms (Facebook, Instagram, TikTok, YouTube, LinkedIn, Pinterest, X, Bluesky, Mastodon, and AI providers) that may experience downtime, API changes, or policy updates beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. Platform availability may vary as we add support for new platforms or if existing platforms modify their APIs.
8. Service Suspension & Termination
By You
You may stop using Sierra at any time. You can disconnect your accounts and request deletion of your data through our dashboard or by contacting us.
By Us
We may suspend or terminate your access if we detect: violations of these Terms, abuse of our service, security threats, or violations of any connected platform's policies. We will provide notice when possible.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- • Sierra is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
- • We are not liable for any indirect, incidental, special, consequential, or punitive damages.
- • We are not responsible for actions taken by Facebook or Instagram regarding your accounts.
- • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
- • We are not liable for any content you publish or its consequences.
10. Indemnification
You agree to indemnify, defend, and hold harmless Sierra and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your content, or your violation of these Terms.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting a notice on our website or sending you an email. Your continued use of the service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of Sierra shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or in courts of competent jurisdiction.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
